Bekendtgørelse af aftale om anvendelsen af artikel 65 i den europæiske patentkonvention

Den 17. oktober 2000 undertegnedes i London aftale om anvendelse af artikel 65 i konvention om meddelelse af europæiske patenter, jf. Udenrigsministeriets bekendtgørelse nr. 31 af 15. marts 1990, Lovtidende C.

Aftalen har følgende ordlyd:

Agreement on the application of Article 65 of the Convention on the Grant of European

Patents

The States parties to this Agreement,

IN THEIR CAPACITY as Contracting States to the Convention on the Grant of European Patents (European Patent Convention) of 5 October 1973,

REAFFIRMING their desire to strengthen co- operation between the States of Europe in respect of the protection of inventions,

HAVING REGARD to Article 65 of the European Patent Convention,

RECOGNISING the importance of the objective to reduce the costs relating to the translation of European patents,

STRESSING the need for widespread adherence to that objective,

DETERMINED to contribute effectively to such cost reduction,

HAVE AGREED ON THE FOLLOWING PROVISIONS:

Article 1

Dispensation with translation requirements

(1) Any State party to this Agreement having an official language in common with one of the official languages of the European Patent Office shall dispense with the translation requirements provided for in Article 65, paragraph 1, of the European Patent Convention.

(2) Any State party to this Agreement having no official language in common with one of the official languages of the European Patent Office

De i denne aftale deltagende stater,

I DERES EGENSKAB af kontraherende stater til konventionen om meddelelse af europæiske patenter (den europæiske patentkonvention) af 5. oktober 1973,

DER GENBEKRÆFTER deres ønske om at styrke samarbejdet mellem Europas stater med hensyn til beskyttelsen af opfindelser,

UNDER HENVISNING til artikel 65 i den europæiske patentkonvention,

DER ANERKENDER vigtigheden af formålet med at reducere omkostningerne i relation til oversættelse af europæiske patenter,

DER UNDERSTREGER behovet for udstrakt overholdelse af dette formål,

DER ER FAST BESLUTTET på at bidrage effektivt til en sådan omkostningsreduktion,

ER BLEVET ENIGE OM FØLGENDE BESTEMMELSER:

Artikel 1

Dispensation fra oversættelseskravene

(1) Enhver i denne aftale deltagende stat, der har et officielt sprog til fælles med et af det europæiske patentkontors officielle sprog, skal dispensere fra oversættelseskravene som foreskrevet i artikel 65, stk. 1, i den europæiske patentkonvention.

(2) Enhver i denne aftale deltagende stat, der ikke har et officielt sprog til fælles med et af det europæiske patentkontors officielle sprog, skal

shall dispense with the translation requirements provided for in Article 65, paragraph 1, of the European Patent Convention, if the European patent has been granted in the official language of the European Patent Office prescribed by that State, or translated into that language and supplied under the conditions provided for in Article 65, paragraph 1, of the European Patent Convention.

(3) The States referred to in paragraph 2 shall continue to have the right to require that a translation of the claims into one of their official languages be supplied under the conditions provided for in Article 65, paragraph 1, of the European Patent Convention.

(4) Nothing in this Agreement shall be construed as restricting the right of the States parties to this Agreement to dispense with any translation requirement or to apply more liberal translation requirements than those referred to in paragraphs 2 and 3.

Article 2

Translations in case of dispute

Nothing in this Agreement shall be construed as restricting the right of the States parties to this Agreement to prescribe that, in the case of a dispute relating to a European patent, the patent proprietor, at his own expense, (a) shall supply, at the request of an alleged

infringer, a full translation into an official language of the State in which the alleged infringement took place,

(b) shall supply, at the request of the competent court or quasi judicial authority in the course of legal proceedings, a full translation into an official language of the State concerned.

Article 3

Signature – Ratification

(3) De i stk. 2 nævnte stater skal fortsat have ret til at kræve, at en oversættelse af kravene til et af deres officielle sprog indleveres i overensstemmelse med betingelserne foreskrevet i artikel 65, stk. 1, den europæiske patentkonvention.

(4) Intet i denne aftale skal tolkes som værende begrænsende for de i denne aftale deltagende staters ret til at frafalde ethvert oversættelseskrav eller til at anvende mere liberale oversættelseskrav end de i stk. 2 og 3 nævnte.

Artikel 2

Oversættelser i tilfælde af stridigheder

Intet i denne aftale skal tolkes som værende begrænsende for de i denne aftale deltagende staters ret til at foreskrive, at i tilfælde af en tvist vedrørende et europæisk patent, skal patenthaveren for egen regning, (a) på anmodning af en påstået krænker,

fremlægge en fuldstændig oversættelse til et officielt sprog i den stat, hvor den påståede krænkelse fandt sted,

(b) på anmodning af den kompetente domstol eller den quasi judicielle myndighed i løbet af retsforfølgningen, fremlægge en fuldstændig oversættelse til et officielt sprog i den omhandlede stat

Artikel 3

Undertegnelse – ratifikation

(1) This Agreement shall be open for signature by any Contracting State to the European Patent Convention until 30 June 2001.

(2) This Agreement shall be subject to ratification. Instruments of ratification shall be deposited with the Government of the Federal Republic of Germany.

Article 4

Accession

This Agreement shall, on expiry of the term for signature mentioned in Article 3, paragraph 1, be open to accession by any Contracting State to the European Patent Convention and any State which is entitled to accede to that Convention. Instruments of accession shall be deposited with the Government of the Federal Republic of Germany.

Article 5

Prohibition of reservations

No State party to this Agreement may make reservations thereto.

Article 6

Entry into force

(1) This Agreement shall enter into force on the first day of the fourth month after the deposit of the last instrument of ratification or accession by eight Contracting States to the European Patent Convention, including the three States in which the most European patents took effect in 1999.

(2) Any ratification or accession after the entry into force of this Agreement shall take effect on the first day of the fourth month after the deposit of the instrument of ratification or accession.

(1) Denne aftale skal være åben for undertegnelse af enhver kontraherende stat i den europæiske patentkonvention indtil den 30. juni 2001.

(2) Denne aftale skal være genstand for ratifikation. Ratifikationsinstrumenter skal deponeres hos Forbundsrepublikken Tysklands regering.

Artikel 4

Tiltrædelse

Denne aftale skal, efter udløbet af fristen for undertegnelse nævnt i artikel 3, stk. 1, være åben for tiltrædelse af enhver kontraherende stat i den europæiske patentkonvention og enhver stat, der er berettiget til at tiltræde denne konvention. Tiltrædelsesinstrumenter skal deponeres hos Forbundsrepublikken Tysklands regering.

Artikel 5

Forbud mod forbehold

Ingen i denne aftale deltagende stat kan tage forbehold hertil.

Artikel 6

Ikrafttrædelse

(1) Denne aftale skal træde i kraft på den første dag i den fjerde måned efter deponering af det sidste ratifikations- eller tiltrædelsesinstrument fra otte kontraherende stater i den europæiske patentkonvention, inklusive de tre stater, hvor de fleste europæiske patenter fik virkning i 1999.

(2) Enhver ratifikation eller tiltrædelse efter ikrafttrædelsen af denne aftale skal have virkning fra den første dag i den fjerde måned efter deponeringen af ratifikations- eller tiltrædelsesinstrumentet.

Article 7

Duration of the Agreement

This Agreement shall be concluded for an unlimited duration.

Article 8

Denunciation

Any State party to this Agreement may denounce it at any time once it has been in force for three years. Notification of denunciation shall be given to the Government of the Federal Republic of Germany. The denunciation shall take effect one year after the date of receipt of such notification. No rights acquired pursuant to this Agreement before the denunciation took effect shall thereby be impaired.

Article 9

Scope

This Agreement shall apply to European patents in respect of which the mention of grant was published in the European Patent Bulletin after the Agreement entered into force for the State concerned.

Article 10

Languages of the Agreement

This Agreement, drawn up in a single original in the English, French and German languages shall be deposited with the Government of the Federal Republic of Germany, the three texts being equally authentic.

Article 11

Transmissions and notifications

Artikel 7

Aftalens varighed

Denne aftale skal have ubegrænset varighed.

Artikel 8

Opsigelse

Enhver i denne aftale deltagende stat kan til enhver tid opsige den, når den har været gældende i tre år. Notifikation om opsigelse skal gives til Forbundsrepublikken Tysklands regering. Opsigelsen skal træde i kraft et år efter modtagelsen af en sådan notifikation. Ingen rettigheder, opnået i henhold til denne aftale før opsigelsen trådte i kraft, skal berøres derved.

Artikel 9

Anvendelsesområde

Denne aftale skal gælde for europæiske patenter, for hvilke meddelelse om udstedelsen har været offentliggjort i den europæiske Patent Bulletin efter aftalen trådte i kraft for den pågældende stat.

Artikel 10

Aftalens sprog

Denne aftale, der er udfærdiget i en enkelt original på det engelske, franske og tyske sprog, skal deponeres hos Forbundsrepublikken Tysklands regering. De tre tekster har samme gyldighed.

Artikel 11

Fremsendelser og notifikationer

(1) The Government of the Federal Republic of Germany shall draw up certified true copies of this Agreement and shall transmit them to the Governments of all signatory or acceding States.

(2) The Government of the Federal Republic of Germany shall notify to the Governments of the States referred to in paragraph 1: (a) any signature; (b) the deposit of any instrument of ratification

or accession; (c) the date of entry into force of this

Agreement; (d) any denunciation received pursuant to

Article 8 and the date on which it will take effect.

(3) The Government of the Federal Republic of Germany shall register this Agreement with the Secretariat of the United Nations.

In WITNESS WHEREOF, the Plenipotentiaries authorised thereto, having presented their Full Powers, found to be in good and due form, have signed this Agreement.

Done at London on 17 October 2000, in one original, in English, French and Germany, each text being equally authentic.

(1) Forbundsrepublikken Tysklands regering skal udfærdige bekræftede kopier af denne aftale og fremsende disse til regeringerne i alle de stater, der har undertegnet eller tiltrådt aftalen.

(2) Forbundsrepublikken Tysklands regering skal underrette de i stk. 1 omhandlede staters regeringer om: (a) enhver undertegnelse; (b) deponering af ethvert ratifikations- eller

tiltrædelsesinstrument; (c) ikrafttrædelsesdatoen for denne aftale;

(d) enhver opsigelse modtaget i henhold til artikel 8 og datoen, hvor denne vil få virkning.

(3) Forbundsrepublikken Tysklands regering skal registrere denne aftale hos De Forenede Nationers sekretariat.

TIL BEKRÆFTELSE HERAF har de befuldmægtigede repræsentanter, der er bemyndiget hertil, efter at have forevist deres fuldmagt, som fandtes at være i god og behørig form, undertegnet denne aftale.

Udfærdiget i London den 17. oktober 2000 i én original på engelsk, fransk og tysk, idet alle tekster skal have samme gyldighed.

Danmarks ratifikationsinstrument deponeredes den 18. januar 2008 i Forbundsrepublikken Tysklands udenrigsministerium og aftalen trådte i medfør af artikel 6, stk. 1, i kraft den 1. maj 2008.

Aftalen finder ikke anvendelse på Færøerne og i Grønland.
