COPYRIGHT ACT

COPYRIGHT (AMENDMENT) REGULATIONS 1998

In exercise of the powers conferred by section 202 of the Copyright Act, the Minister for Law hereby makes the following Regulations:

Citation and commencement

1. These Regulations may be cited as the Copyright (Amendment) Regulations 1998 and shall come into operation on 16th April 1998.

New regulation 4A

2. The Copyright Regulations (Rg 4) are amended by inserting, immediately after regulation 4, the following regulation:

Institution assisting intellectually handicapped readers

4A. For the purposes of the definition of “institution assisting intellectually handicapped readers” in section 7(1) of the Act, each of the institutions specified in the Eighth Schedule is declared to be, for the purposes of the Act, an institution assisting intellectually handicapped readers.”.

Amendment of regulation 7

3. Regulation 7 of the Copyright Regulations is amended —

(a) by deleting the word “teaching” in the fourth line of paragraphs (1) and (2) and substituting in each case the word “educational”;

(b) by deleting the words “section 54(7)” in paragraph (3) and substituting the words “sections 54(7) and 54A(4)”; and

(c) by deleting the words “section 54(8)” in the first line of paragraph (4) and substituting the words “sections 54(8) and 54A(5)”.

Amendment of regulation 8

4. Regulation 8 of the Copyright Regulations is amended —

(a) by deleting the words “or 54(9)(a)” in the first line of paragraph (1) and substituting the words “, 54(9)(a) or 54A(6)(a)”;

(b) by deleting the words “or 54(9)(b)” in the second line of paragraph (2) and substituting the words “, 54(9)(b) or 54A(6)(b)”; and

(c) by deleting the words “and 54(10)” in paragraph (4) and substituting the words “, 54(10) and 54A(7)”.

Amendment of regulation 9

5. Regulation 9 of the Copyright Regulations is amended —

(a) by deleting the word “or” at the end of paragraph (2)(a);

(b) by deleting the comma at the end of sub-paragraph (b) of paragraph (2) and substituting the word “; or” and by inserting immediately thereafter the following sub-paragraph:

“(c) an intellectually handicapped reader’s copy of the whole or a part of a work is made in reliance on section 54A of the Act by or on behalf of the body administering an institution assisting intellectually handicapped readers,”; and

(c) by deleting the words “or institution assisting handicapped readers” in the third line of paragraph (3) and substituting the words “, institution assisting handicapped readers or institution assisting intellectually handicapped readers”.

Amendment of regulation 10

6. Regulation 10(2) of the Copyright Regulations is amended —

(a) by deleting the words “or an institution assisting handicapped readers” in the first and second lines and substituting the words “, an institution assisting handicapped readers or an institution assisting intellectually handicapped readers”; and

(b) by deleting the words “or institution assisting handicapped readers” in the fourth and fifth lines and substituting the words “, institution assisting handicapped readers or institution assisting intellectually handicapped readers”.

Amendment of regulation 11

7. Regulation 11 of the Copyright Regulations is amended —

(a) by deleting the words “or an institution assisting handicapped readers” in paragraph (2) and substituting the words “, an institution assisting handicapped readers or an institution assisting intellectually handicapped readers”; and

(b) by deleting the words “or 54 of the Act, of copies, or handicapped readers copies” in paragraph (2)(a) and substituting the words “, 54 or 54A of the Act, of copies, handicapped readers” copies, or intellectually handicapped readers’ copies”.

Amendment of Fifth Schedule

8. The Fifth Schedule to the Copyright Regulations is amended —

(a) by deleting the words “SECTION 54(7) AND (9)” in the heading and substituting the words “SECTION 54(9) OR 54A(6)”; and

(b) by inserting, immediately after the word “readers”” in the sub-heading, the words “or institution assisting intellectually handicapped readers””.

Amendment of Seventh Schedule

9. The Seventh Schedule to the Copyright Regulations is amended —

(a) by deleting the words “SECTION 54(8) AND (9)” in the heading and substituting the words “SECTION 54(9) OR 54A(6)”; and

(b) by inserting, immediately after the word “readers”” in the sub-heading, the words “or institution assisting intellectually handicapped readers””.

New Eighth Schedule

10. The Copyright Regulations are amended by inserting, immediately after the Seventh Schedule, the following Schedule:
