The Constitution of the Independent State of Samoa was adopted by the people of Samoa through the Constitution Convention 1960 and it came into force on January 1, 1962. It is the supreme law of Samoa and provides for the separation of powers (Part IV, V and VI).
The Constitution does not contain specific provision on the protection of intellectual property rights. However, Article 14 'Rights regarding property' of Part II 'Fundamental Rights' prohibits the deprivation of private property, providing in part: '(1) No property shall be taken possession of compulsorily, and no right over or interest in any property shall be acquired compulsorily...'
