Notes
The Industrial Property Code (IPC) enacted pursuant to Article 15 of Law No. 273 of December 12, 2002 repeals all previous national IP laws, except the copyright law. It unifies into a single law all intellectual property subject matters, except for copyright and unfair competition covered by specific laws and provisions.
The IPC introduces the following major changes to the previous IP laws :
-providing a new definition of industrial property which expressly includes geographical indications; designations of origin and company confidential information;
-reforming the provisions governing the employees' and university researcher’s inventions;
-providing stronger protection for internet domain names;
-introducing a new definition of counterfeiting and piracy;
-giving a better definition for the jurisdiction of the 12 intellectual property tribunals and reinforcement of criminal sanctions for infringements of industrial property rights;
-entrusting more tasks and responsibilities to the Italian Patent and Trademark Office (PTO).
