Year of Version 2012 Dates Reprinted as of: December 1, 2012 Amended up to: May 8, 2012 Entry into force: January 1, 1948 Promulgated: December 27, 1947 Type of Text Constitution/Basic Law Subject Matter Other Notes This consolidated version of the Constitution of the Republic of Italy takes into account amendments up to "Constitutional Law No. 1 of April 20, 2012, on the Introduction of the Principle of Balanced Budget in the Constitutional Charter", which entered into force on May 8, 2012. The said constitutional amendment Law No. 1 introduced amendments to Articles 81, 97, 117 and 119 of this consolidated version of the Constitution. The consolidated Constitution of the Republic of Italy contains general provisions relating to intellectual property. Article 9 under the Fundamental Principles provides for the duty of the State to promote scientific and technical research, and safeguard the historical and artistic heritage of the nation. Part I, Title II, Article 33 guarantees the freedom of arts, science and teaching. Furthermore, Part II, Title V, Article 117, paragraph 2, r) gives the State the exclusive legislative power to enact laws relating to intellectual property. Article 117, paragraph 3 gives both the State and regions the concurrent power to enact laws relating to scientific and technological research and promotion of the cultural heritage.
