This Order amends the Patents Act 1977 in its application to the Isle of Man. It replaces the Patents Act 1977 (Isle of Man) Order 2003, and makes additional modifications to correspond to the amendments made to the Act by the Medicines (Marketing Authorisation Etc.) Amendment Regulations 2005, the Intellectual Property (Enforcement, etc.) Regulations 2006, the Registered Designs Act 1949 and Patents Act 1977 (Electronic Communications) Order 2006, the Patents (Compulsory Licensing and Supplementary Protection Certificates) Regulations 2007 and the Patents Act 1977 (Amendment) Regulations 2011.
Among others, the Schedule on 'Modifications of the Patents Act 1977 in its application to the Isle of Man', established under article 2 of this Order specifies the amendments to section 1(3)& (4) dealing with patentable inventions; section 5(5) on priority date; section 41 dealing with amount of compensation; section 46(3)(c); sections 48, 48A, 48B on compulsory licensing; section 52 on opposition, appeal and arbitration; section 76A on biotechnological inventions; the insertion of a new 118A on copyright in documents made available electronically for inspectation under section 118(1); section 124A on the use of electronic communications; the insertion of section 128A on EU compulsory licences that provides a definition of an 'EU compulsory licence' under Regulation (EC) No 816/2006 of the European Parliament and of the Council of 17 May 2006 on compulsory licensing of patents relating to the manufacture of pharmaceutical products for export to countries with public health problems; section 128B that provides a definition of the term 'supplementary protection certificates' under the Council Regulation (EEC) No 1768/92 of 18 June 1992 concerning the creation of a supplementary protection certificate for medical products or Regulation (EC) No 1610/96 of the European Parliament and of the Council of 23 July 1996 concerning the creation of a supplementary protection certificate for plant protection products'; insertion of ScheduleA1 on derogation from patent protection in respect of biotechnological inventions, referring, inter alia, to the Council Regulation (EC No. 2100/94 of 27th July 1994 on Community plant variety rights; Schedule A2 on the biotechnological inventions and Schedule 4A on supplementary protection certificates.
