Year of Version 2013 Dates Entry into force: September 15, 2002 Issued: August 2, 2002 Type of Text Implementing Rules/Regulations Subject Matter Copyright and Related Rights (Neighboring Rights), Enforcement of IP and Related Laws, IP Regulatory Body Notes The Regulations for the Implementation of the Copyright Law of the People's Republic of China were promulgated by the Decree No. 359 of the State Council of the People's Republic of China on August 2, 2002, and entered into force on September 15, 2002.
These Regulations were amended for the first time in accordance with the 'Decision of January 8, 2011, of the State Council on Abolishing and Amending Some Administration Regulations'; and amended for the second time in accordance with the 'Decision of January 30, 2013, of the State Council on Amending the Regulations for the Implementation of the Copyright Law of the People's Republic of China', which were promulgated by the Decree No. 633 of the State Council and entered into force on March 1, 2013 (see Article 36 of the Regulations for detailed amendments).

The notification by China to the WTO under Article 63.2 of TRIPS states:
'The second revision to the Regulations for the Implementation of the Copyright Law of the People's Republic of China aims to enhance the protection of intellectual property, specially, it increases the penalty for the administrative penalties:
1. The fine was calculated in accordance with the illegal profit which was subdivided and increased from 3 times to 5 times;
2. Raising the ceiling of the fine (from 100,000 yuan to 250,000 yuan).
The revised Regulations for the Implementation of the Copyright Law entered into force on March 1, 2013.'
