The notification by Spain to the WTO under article 63.2 of TRIPS states:
'This Law regulates penal categories relating to offences against intellectual property rights in general, which is relevant for the purposes of Article 61 of the TRIPS Agreement.
Articles 270 and 271 describe practices deemed to be infringements of intellectual property in the form of copyright and neighboring rights, and the corresponding penalties.
Articles 273 to 278 set forth similar provisions in regard to patents, utility models, layout designs (topographies) of integrated circuits, trademarks, geographical indications and protection of undisclosed information.
The Law also contains provisions on general penalties applicable to any 'corpus delicti'. Hence, Articles 109 ff. deal with the restoration of the good, redress for damages and indemnification for loss. Article 127 deals with seizure.'
