Year of Version 2011 Dates Entry into force: December 22, 2011 Adopted: December 20, 2011 Type of Text Main IP Laws Subject Matter Copyright and Related Rights (Neighboring Rights) Notes This Law implements, inter alia, an obligation to inform the purchasers of devices subject to copyright levies by introducing a new Article L.311-4-1 after L.311-4 of the Intellectual Property Code ('IPC'), which reads, inter alia:
The amount of the copyright levy, referred to in Article 311-3, subject to each type of device, is brought to attention of the purchaser when the recording device referred to in Article L.311-4 is put on sale.
An explanatory manual explaining the copyright levy and its purpose, which are also brought to the purchaser's attention, can be integrated to the device itself in a dematerialized manner, and must mention the possibility to enter into an exoneration agreement or to obtain a refund of the copyright levy in accordance with the conditions referred to in Article L.311-8.
